Tow yard fees are eating me alive — do I file the claim now or wait?

So I got into a pretty bad wreck about four days ago. The other driver ran a red light and hit me on the passenger side. My car got towed to some lot by the city and I've just been kind of frozen, not sure what my next move is.

Here's my problem: I know tow yards charge daily storage fees and mine is already racking up. A few people I know are telling me to somehow get the car out of there first and try to assess the damage myself before I touch the insurance claim. But honestly looking at the photos I took at the scene, the whole front quarter panel is pushed inward, the dashboard cracked, and both airbags went off. That doesn't scream "fixable in a driveway" to me.

On the other hand, if I file the claim and they total it, does the insurance company then take over dealing with the tow yard and the storage fees? Or am I still on the hook for all of that?

I also don't have a rental car right now which is making everything harder — I've been bumming rides to work all week.

I guess I'm just scared that filing the claim opens a can of worms and they lowball me on the value of the car. It's not brand new but I've kept it in great shape and put a lot into it over the years.

Has anyone been through something like this? What would you actually do in my shoes? I feel like every hour I wait is costing me money but I also don't want to make a wrong move.

    Be careful — when you file, the adjuster is going to want to move fast and get you to accept a settlement offer before you've even had time to think. They have every incentive to close your file quickly and cheaply. Don't sign anything or accept any payment until you actually know what your car is worth AND what your medical situation looks like. Were you injured at all? That matters a lot here.

    I was in almost this exact situation last year. The storage fees were brutal — like, genuinely shocking how fast they add up. Once I finally filed, the insurance company sent someone out to inspect it within a couple days and they handled the release from the lot directly. Waiting did nothing for me except cost more money. If the airbags deployed I'd just file.

    A couple of things worth knowing: if the other driver ran the red and is clearly at fault, you may be able to file against THEIR liability coverage instead of your own. That can sometimes change how storage fees get handled. Also, keep every single receipt and document every day the car sits in that lot — that's potentially recoverable as part of your damages. Not telling you what to do legally, just things worth asking about.

    Not legal advice, but since the other driver was apparently at fault, you may have more options than you realize — including having an attorney send a demand that storage fees be covered as part of your property damage claim. A lot of PI attorneys do free consultations and can at least help you understand what you're entitled to before you talk to any adjuster. Worth a call before you settle anything.

    Former adjuster here. Honestly? File the claim. The idea that waiting gives you some kind of leverage is mostly a myth, especially when storage is accumulating. What DOES matter is that you document everything — photos, any repair estimates, your car's maintenance records if you have them. When they calculate actual cash value, you can push back if you have evidence the car was well-maintained. That stuff genuinely moves the needle a little.

      Can I ask — how are YOU feeling physically? Sometimes after a bad impact people are so focused on the car and the logistics that they ignore their own body. Adrenaline can mask a lot in the first 24-48 hours and then things show up later. If you haven't seen a doctor yet, please go. Even if you feel okay. It matters for your health and honestly it matters for any claim too.

    This sounds so stressful, I'm sorry you're dealing with all of it at once. The car stuff AND no rental AND trying to get to work — that's a lot. I hope you have someone helping you through this in person too. Don't try to white-knuckle this alone.

    Airbags deployed + visible frame damage = total loss, almost certainly. No mechanic is fixing that in someone's garage. File the claim today, not tomorrow. The longer you wait the worse this gets financially and it doesn't get you anything.
