Rear-ended on the highway, panicked, let a sketchy tow guy take my car — now what?

So I got hit from behind on the interstate last week during rush hour traffic. It was chaos — cars everywhere, horns going off, I was shaking. A tow truck showed up almost immediately (like, suspiciously fast) and the driver was super pushy about taking my car to "his shop." I was flustered and just said yes.

Now I'm doing my homework and the shop he took it to has maybe 4 legit reviews buried under a pile of obvious fake ones. The real reviews are not good — people saying the shop dragged out repairs forever, charged for stuff that wasn't done, and one person said they had a nightmare trying to get their car released.

Here's the thing though — my car really doesn't seem that bad. Rear bumper is messed up, trunk has a crinkle, but the car drove fine before the tow. No airbags went off. I could still open and close all the doors normally at the scene.

The shop hasn't given me a formal estimate yet, just a guy on the phone saying it "might be a write-off" after having it for two days. That feels off to me.

Can I even move my car to a different shop at this point? Do I have to pay some kind of storage or release fee? My insurance hasn't assigned an adjuster yet — should I wait for them or just go get my car out of there ASAP?

I really regret not thinking straight at the scene. Lesson learned I guess, but right now I just want my car back.

    Oh man, I fell for the same thing after my accident two years ago. Those tow trucks that show up out of nowhere are called "chasers" and they get kickbacks from shady shops. I waited too long and ended up owing a storage fee for like 10 days before I figured out I could just demand my car back.     Don't let that shop write the damage estimate if you can help it. A shop with an incentive to total your car will find every possible reason to do it. You want either your own insurance's appraiser or an independent one looking at it — not someone who profits from calling it a write-off.

The shop has what's called a possessory lien, meaning they can hold it for legitimate charges (like the tow itself), but they can't hold it hostage indefinitely or inflate fees unreasonably. Ask them for an itemized written statement of what you currently owe before you go pick it up. If they try to charge you for "storage" for days before they even touched it, that's something you can push back on. Document everything — take photos the moment you get it back.

    Stop waiting. Call your insurance, tell them the shop is uncooperative and you want the vehicle relocated today. Then call the shop, ask for the total charges so far in writing, and arrange pickup. Don't argue with them on the phone — just get the number, pay to get it out, and deal with reimbursement later. Every day you wait this gets more complicated and more expensive.

    Did you sign anything at the scene or at the shop when they took the car? Like a repair authorization form? That matters a lot here. If you signed something authorizing repairs, that's a different situation than if you only authorized the tow. Worth figuring out exactly what paperwork you agreed to before you assume you can just walk in and take it.
