Other driver's adjuster went quiet after my recorded statement — normal or stalling?

So I was rear-ended at a red light about six weeks ago. Police came, wrote up a report, and cited the other driver for following too closely and distracted driving. Pretty open-and-shut as far as fault goes, at least on paper.

I filed directly with the at-fault driver's insurance since liability seemed clear. First week or two the adjuster was super on top of it — called me right away, asked for photos, scheduled a virtual inspection, then had me do a recorded statement over the phone. I'd done some reading beforehand so I kept my answers short and stuck to the facts.

Then… silence. That was almost three weeks ago.

I've left two voicemails and sent one email. Got one two-sentence reply saying the claim is "still under review." My car is sitting in a shop right now and the rental coverage I'm paying out of pocket is adding up fast.

A few things I can't figure out:

  • Does the adjuster actually work for the insurance company, or are some of them outside contractors? Does that change anything?
  • Is there any real pressure on them to move fast, or can they just drag this out indefinitely?
  • Should I be going through my own insurance instead and letting them fight it out?

I'm not trying to be dramatic — I just genuinely don't know if this is normal claim processing time or if something sketchy is happening. Anyone been through this? What actually gets things moving again?

Also my state apparently has rules about how long insurers have to respond but I have no idea if those actually get enforced or if it's just a suggestion lol.

      Are you dealing with any physical symptoms from the crash? Even if you feel fine right now, some soft tissue stuff doesn't show up for days or weeks. I'd really encourage you to see a doctor if you haven't — both for your health and because if anything surfaces later, having it documented early matters a lot. Don't let the car situation be the only thing you're focused on.

Some adjusters are staff (direct employees), and yeah, some companies use independent adjusting firms — especially when they're slammed with volume. Either way, neither type has a strong personal incentive to rush YOUR claim. Their performance metrics are usually about cost control, not speed. The silence after a recorded statement is sometimes just backlog, but it can also mean they're reviewing to see if there's anything they can use to push partial fault onto you. Don't read too much into it either way, but don't be passive either. Keep a log of every contact attempt with dates and times.

They're hoping you'll get frustrated, need your car back, and settle for whatever they offer just to make it stop. Do not let the rental costs pressure you into accepting a lowball. That's literally part of the playbook.

    Most states have what's called a "fair claims settlement" regulation that sets deadlines — usually something like 10-15 business days to acknowledge a claim and 30-45 days to accept or deny after getting all the info they need. The key wording is usually after they have everything they need, which they can stretch by claiming they're still investigating.     File through your own collision coverage NOW and let your insurer go after theirs through subrogation. Yes you'll pay your deductible upfront, but your car gets fixed fast and you stop bleeding rental money. Your insurer has way more leverage with theirs than you do as an individual. You'll get the deductible back once fault is confirmed — which sounds like it shouldn't be hard here.

      What does "still under review" actually mean in context here — did they say they were waiting on anything specific, like a statement from their own insured or additional documentation? Sometimes three weeks isn't stalling, it's just slow. I'd want to know if they've formally accepted liability yet or not before assuming the worst.
