Hurt passenger in my friend's car — no insurance, no one helping me, still dealing with symptoms

This whole situation has been a nightmare and I don't even know where to start.

About two months ago I was riding in the back seat of my buddy's car when another driver blew through an intersection and hit us. My friend didn't have insurance on the car — I had no idea. The other driver was speeding, but there's some argument about whether my friend had enough visibility before pulling out. Either way, I ended up the worst off: fractured collarbone, two cracked vertebrae, and a pretty serious concussion that hasn't fully resolved. My friend and the other passenger walked away with minor stuff.

Here's where it got really messy. I live alone. After the ER discharged me with a stack of aftercare papers, I had literally nobody to help me get to follow-up appointments. I couldn't drive myself, couldn't afford rideshares constantly, and I didn't have a regular doctor. I basically just tried to manage on my own for weeks. The headaches and brain fog have actually gotten worse over time, not better.

My friend eventually hired a lawyer — a well-known firm in our city — and I just assumed they were covering all of us. Turns out they only represent her. When I called to ask about my situation they basically said they couldn't help me and passed me off somewhere else without any real explanation.

I have a mountain of hospital bills, I'm still not back to full cognitive function, and I genuinely don't know who I'm supposed to be making a claim against or even if I have any options. Does anyone have experience being a passenger in an uninsured car when the accident wasn't your fault at all? I feel completely invisible in this whole process.

      Please, please be careful if the at-fault driver's insurance company contacts you directly. They will seem super friendly and helpful, and then they'll use everything you say to minimize your payout. Don't give a recorded statement without talking to someone first. The fact that you delayed follow-up care because you literally couldn't get there? They will absolutely try to use that against you.

    A few things worth knowing here, not legal advice just process stuff: as an injured passenger you can typically pursue the at-fault driver's liability coverage independently, regardless of whether your friend's car was insured. Also worth checking whether you have your own auto policy — even if you don't own a car, some renters or personal auto policies have uninsured/underinsured motorist coverage that can apply when you're a passenger. And the gap in your medical care is actually really common in cases like yours; it doesn't automatically kill your claim, especially if you can document why you couldn't follow up.

    From the other side of the desk: the at-fault driver's insurance company does owe a duty to all injured parties, not just the drivers. As a passenger you're generally considered the most sympathetic claimant in any claim file — you clearly did nothing wrong. What will complicate things is the gap in treatment and the question of shared fault between the two drivers. Adjusters will look at that shared fault question closely because it affects how much of the total damages they might ultimately owe. Get someone in your corner before you say much to them.

    I just want to say — removing your own stitches and managing cracked vertebrae alone because you had no one to help you is genuinely heartbreaking. The uninsured status of your friend's car limits some avenues but doesn't close all of them. The worsening neurological symptoms also matter a lot for damages. Call around, get a free consult, and specifically ask each attorney about uninsured vehicle passenger claims. Also, start a symptom journal today if you haven't. Dates, symptoms, how it's affecting your daily life. That stuff matters way more than people realize.
