Hit by uninsured driver, no UM coverage, now in collections — what do I even do?

I'm honestly at a loss and just need to hear from people who've been through something similar.

About two months ago I got rear-ended pretty badly at a red light. The other driver admitted fault at the scene and the police report backs that up completely. I ended up in the ER with soft tissue damage to my neck and back, plus some rib bruising. Missed almost two weeks of work.

My medical bills ended up being substantial. My own auto insurance has PIP, which chipped away at some of it — but there's still a big chunk left over that wasn't covered. The real gut-punch came when I found out the at-fault driver's insurance had lapsed. Like, he handed the officer a valid-looking insurance card and everything, but the policy had been cancelled months earlier.

Then I checked my own policy more carefully and realized I never added uninsured motorist coverage. I honestly didn't even know that was a separate thing you had to opt into. Nobody ever explained that to me when I bought the policy.

So now I'm sitting here with:

  • A remaining medical balance that just got sent to a collections agency
  • An at-fault driver who, from what I can tell, has zero assets
  • No UM coverage to fall back on

I've already called the hospital's billing department and asked about hardship assistance — they sent me some forms but I haven't heard back. I've also been reading about whether it's even worth suing someone who probably can't pay a judgment anyway.

Has anyone actually been in this exact situation? Did suing the uninsured driver do anything useful, or is it just throwing more money away? And has anyone had real success negotiating down a bill that's already in collections? I feel like I'm being punished for something that was completely not my fault.

    Ugh, I went through almost the exact same thing a few years back. Uninsured driver, no UM on my policy, bills piling up. The collections thing is scary but honestly the hospital billing department was way more willing to negotiate once I could show them I genuinely had no insurance coverage to pull from. Fill out every hardship form they send you and follow up every single week — squeaky wheel really does get the grease there.

    On the suing-the-uninsured-driver question — you can get a judgment against someone with no assets, but collecting on it is a whole separate problem. That said, judgments can sometimes be renewed for years, so if the person's financial situation ever changes, you'd have a legal claim waiting. It's not nothing, but it's also not a quick fix. Talking to a PI attorney for even a free consultation might help you figure out if there's any realistic path forward, because some attorneys are good at finding assets people think they've hidden.

      Quick question — did you have health insurance at the time of the accident? If so, did you submit the bills through them? Sometimes people go straight to auto insurance and forget that health insurance can cover accident injuries too, even if there's eventually a reimbursement process involved. Just want to make sure that option isn't sitting on the table untouched.

    Just be really careful if any adjuster or collections rep tries to get you to sign anything or make a recorded statement about the accident. Even in situations like yours where the fault is clear, those things can be used to minimize whatever options you still have. Read everything twice before you sign.

    Please don't put off any follow-up care because of the billing stress — I know it's tempting when you're already drowning in debt, but soft tissue and rib injuries can get way worse if you ignore them. Some providers will work out payment plans or defer billing while you're sorting out the legal side. Your health has to come first.

      Honest take: suing someone with no money is usually a waste of time and court fees. Focus your energy on the hospital hardship program — those exist for exactly your situation and can sometimes knock the balance down dramatically. Get the forms in ASAP and document everything: the police report, the proof that the other driver was uninsured, your missed work. The more paper trail you have, the better your case for assistance.
