Guy merged into me, now wants to file a claim — but I have zero damage. What happens to my rates?

So this happened on the highway a few days ago and I'm still kind of spinning about it.

I was cruising in my lane, minding my own business, when the car to my left just... drifted over. No signal, no warning. He clipped the side of my car getting over. I laid on the horn but it was too late. We both pulled over and honestly the whole thing felt pretty minor in the moment — we exchanged info and I thought that was that.

Here's the thing though: I have no visible damage on my car. Like, I looked all over and I cannot find a scratch. His bumper has a small scuff but nothing dramatic.

Now he's texting me saying he wants to open a claim. I have a dashcam and honestly the footage is pretty clear that he came into MY lane — I didn't move at all.

My questions: 1. If he files a claim against my insurance and I'm clearly not at fault, will my rates still go up? 2. Should I report it to my insurance first before he does, just to get ahead of it? 3. Is there any situation where I could be considered partially at fault here?

I'm a pretty cautious driver and I've never dealt with anything like this before. I'm not trying to be difficult — I just don't want to get stuck paying more for something that genuinely wasn't my fault. Any advice from people who've been through this would really help. 🙏

      The dashcam footage is key. Make sure you back it up somewhere RIGHT NOW — cloud, hard drive, multiple places. Footage sometimes gets overwritten or corrupted and you don't want to lose that. Also, write down everything you remember about the incident while it's fresh: time, road conditions, what lane you were in, whether you braked or swerved. Even small details can matter if this escalates.

    Former auto claims adjuster here. A few things: yes, report it to your carrier proactively — it protects you. As for rates, it really depends on your state and your policy. Some states have laws preventing rate increases on not-at-fault claims, but others don't. Your dashcam footage is genuinely your best asset here. If it clearly shows him crossing into your lane, his claim is going to have a very hard time going anywhere.

    Not legal advice, but in most states your rates shouldn't increase for a not-at-fault accident — especially one with video evidence.     Quick question — did you move at all when he started coming over? Like did you brake hard or jerk the wheel? I'm not saying you're wrong, just that 'I didn't move at all' is the kind of thing that gets tested if there's any dispute. The dashcam will answer that pretty definitively.

      Call your insurance. Tell them you have dashcam footage showing the other driver crossed into your lane. Do it today. Stop texting back and forth with the other driver — you don't need to negotiate anything directly with him. Let the insurance companies sort it out. That's literally what you pay them for.
