Got a weird message in my insurance portal — does this mean I'm being sued??

So I logged into my insurance account this morning just to check something unrelated and I noticed a new message sitting there that I definitely did not expect.

It's from someone at my insurance company I've never heard of before — not the person I've been dealing with since the crash. This new person says they're now handling my 'coverage and liability investigation' and also something called a 'bodily injury claim presented against my policy.' They just left a phone number and asked me to call.

I've been kind of a nervous wreck since I read it. Like... does 'presented against my policy' mean the other driver is suing me? Or is this just normal insurance stuff that sounds scarier than it is?

For context: I was in a two-car accident about two months ago. It was a pretty low-speed collision in a parking lot and honestly there wasn't much visible damage to either vehicle. The other driver seemed fine at the scene — we exchanged info, nobody called an ambulance or anything. I filed with my insurance right after.

I didn't expect to hear anything like this. I'm not sure if I should:

  • Call this adjuster back right away
  • Talk to my original claims rep first
  • Get a lawyer before I say anything to anyone

Has anyone else gotten a message like this out of nowhere? I'm honestly not sure what step to take first and I'm kind of spiraling a little. Any insight would really help.

    Okay first — breathe. I got almost the exact same message after a fender bender I was involved in and I completely panicked. What it usually means is that the other driver filed an injury claim with your insurance, which triggers a different department to get involved. It doesn't automatically mean a lawsuit. It just means someone is saying they got hurt and your insurer has to investigate it.

      Not legal advice, but this is actually a good moment to at least have a free consultation with a PI attorney — not because you're definitely in trouble, but because once bodily injury is on the table, the dynamics shift and it helps to understand your rights. Most attorneys offer free consults and can tell you whether you even need representation. Knowing your position before that call with the adjuster isn't a bad idea.

    Before you call that adjuster back, just know — they work for the insurance company, not for you. Their job is to protect the company's payout, and sometimes that means getting you to say things that can be used to minimize or complicate your own coverage. Be careful about volunteering extra details you weren't directly asked about.

When you see 'coverage and liability investigation,' that means they're looking at two things: (1) whether your policy actually covers this situation and (2) who's legally at fault. A bodily injury claim being 'presented against your policy' just means the other party told their insurance or your insurance that they were hurt. It does NOT automatically equal a lawsuit. That said, it can escalate if the claim gets big enough. I'd call the adjuster back but keep it short — answer what they ask and don't offer extra commentary.

    A bodily injury claim and a lawsuit are two totally different things, just so you know. A claim is basically the other person saying 'I was hurt and I want compensation.' A lawsuit is when they actually file in court. Most claims never turn into lawsuits — they get settled at the insurance level. The fact that you're seeing a new adjuster assigned usually means the claim has grown beyond the basic property damage stage. Not necessarily scary, just a different phase.

    Call the adjuster back. Don't ghost them — that makes everything worse. Keep it brief, be polite, and just listen to what they have to say before you assume the worst. You can always pause the conversation and say you need to call back before answering anything specific. You've got more control here than it feels like right now.
