Got a check from at-fault driver's insurer for repairs — do I HAVE to spend it on the car?

So this whole thing has been kind of surreal and I want to make sure I'm not about to do something dumb.

About six weeks ago someone in a company van backed into my car in a parking lot while I was inside a store. Security footage caught the whole thing, the driver admitted fault immediately, and their employer's fleet insurance reached out to me super fast — almost suspiciously fast, honestly.

They asked me to get an estimate from a body shop, which I did. A few days later they just... deposited money into my account. No forms to sign, no release, nothing. I followed up and asked if they needed proof that I actually got the work done or receipts for anything, and the claims rep said something like "that's your settlement for vehicle damage, use it however you'd like."

Here's my situation: the dent is on the rear quarter panel. It bothers me cosmetically but my car still drives fine. A buddy of mine who does bodywork said he could probably bang it out for way less than what I was sent. The difference would genuinely help me cover first and last month's rent on a new place I've been trying to get into for months.

I guess my questions are:

  • Can they come back later and demand proof of repairs or ask for the money back?
  • Does not repairing it affect me somehow with MY insurance down the road?
  • Is there any reason I should be worried about accepting this and moving on, or is this actually as simple as they made it sound?

I didn't sign anything releasing future claims. I don't know if that matters. Just want to make sure I'm not stepping into a trap here. Thanks in advance.

    Former adjuster here. When an insurer sends you an indemnity payment without requiring a signed release or proof of repair, they've essentially closed the file and written it off. They are not going to audit what you did with that money — it's not how claims departments work. The check is yours. The bigger thing I'd flag: you mentioned you didn't sign a release. That's actually worth paying attention to. It means you might still have the ability to come back if you discover additional damage or even an injury you didn't notice right away. Most people don't realize that. Don't go signing anything they send you later without reading it carefully.

    Honestly this sounds okay to me based on what you described, but I totally get the anxious feeling. It seems too easy and that makes you second-guess it. The no-release thing is interesting though — I'd keep that in your back pocket just in case. Hope the new place works out! 🙌

    Not legal advice, but the absence of a signed release is genuinely significant. In most states, paying out money without getting a release doesn't automatically extinguish your right to pursue additional claims — for property damage or anything else. If you ever notice the structural integrity of the car is off, or if a related issue pops up later, you may still have options. Just don't sign anything labeled 'Release' or 'Full and Final Settlement' without understanding what you're giving up. If they send something like that, it costs nothing to have someone glance at it first.

    I'll just throw this out there — sometimes after an impact you feel fine in the moment and then a week or two later your neck or back starts talking to you. If that happens, don't assume it's unrelated just because you already got paid for the car. Document any symptoms that come up and see a doctor. The car money and a potential injury claim are two different things.

    The speed at which they paid you is the part that would make me nervous, honestly. When an insurer moves FAST and doesn't ask for anything in return, sometimes it's because they're trying to close out a claim before you realize there's more to it. Did you have any passengers? Any soreness afterward, even minor? Just something to think about before you consider this totally over.

    The key distinction is whether they sent you a general release to sign along with that payment. If they didn't — and it sounds like they didn't — that payment is likely just for the property damage and doesn't bar any other claims. Keep every communication you've had with them in writing, including that message or voicemail where the rep said you could use the money however you like. That's actually useful documentation if anything ever gets weird later.

    Almost the exact same thing happened to me after a delivery truck clipped my bumper. They sent money, I asked about receipts, they said nope. I used most of it for other stuff and had a friend do a cheaper fix. That was over two years ago and I never heard another word from them. I think once they close the claim on their end, they're done.

    You didn't sign a release. They didn't ask for receipts. The rep told you it's yours. Use the money for your rent. Get your friend to fix the dent cheap. Move on with your life. Just save all your texts and emails from the insurer forever.
