First accident ever — should I already be talking to a lawyer or is it too soon?

So this whole thing is brand new to me and honestly I feel like I'm just stumbling around in the dark.

About three weeks ago someone ran a red light and hit the driver's side of my car. The other driver was cited at the scene, so liability feels pretty clear-cut, but I've still got this dull ache in my neck and upper back that just won't go away. My doctor says it's soft tissue stuff and to give it time, but "give it time" doesn't really tell me how long or how bad it might get.

The other driver's insurance has already called me twice. They were super friendly, asked how I was feeling, mentioned something about wrapping things up quickly. I didn't commit to anything but I also didn't really push back — I just kind of said I was still being evaluated.

Here's my actual question: is it too soon to call a personal injury attorney, or is that exactly the right moment? I keep going back and forth. Part of me thinks I should wait and see if the pain clears up on its own. The other part of me wonders if by the time I know I need a lawyer, I'll have already made some mistake that hurts me.

I've never dealt with insurance negotiations before. I don't know what's a lowball offer versus a fair one. I don't even fully understand what I'm entitled to claim.

Has anyone else been in this spot right at the beginning and wished they'd done something differently? I'd really appreciate hearing what people did and whether it helped.

    I was in almost this exact situation two years ago — soft tissue injury, other driver clearly at fault, insurance calling early and being weirdly nice about it. I waited too long thinking it would just resolve itself. By the time I realized my neck issue was more serious than I thought, I'd already had a couple of phone calls with the adjuster where I said things like "I'm feeling okay" that they later used to frame my injury as minor. Call a lawyer now, even just for a free consult. You're not committing to anything.

      I used to work claims for a large carrier, so I'll be straight with you. When an adjuster calls an injured person that fast and starts asking how they're "feeling," there's usually a goal involved — close the file cheap before medical treatment piles up. They're not doing you a favor by being friendly. The whole point of reaching out early is to get you to minimize your own injuries before you fully know the extent of them. A free consult with a PI attorney costs you nothing and at least gives you a baseline for what to expect.

    That "friendly" adjuster calling you twice already? That's not kindness — that's them trying to get a recorded statement or a quick lowball settlement before you understand what your injury actually is. Soft tissue injuries can take weeks or even months to fully show up. Once you accept a settlement, that's it. You can't go back. Please don't talk to them again without at least knowing your rights first.

      Not legal advice, but generally speaking — the best time to consult with a personal injury attorney after an accident is before you've given any recorded statements and before you've signed anything. You haven't done either of those things yet, which puts you in a good spot. Most PI attorneys will tell you in a free consult whether your situation is worth pursuing and what pitfalls to watch for. At minimum it gives you information. At best it protects you from a mistake that's hard to undo.

    Honestly just the fact that you're in pain AND the insurance company is already calling you repeatedly would stress me out completely. Please don't try to figure all of this out alone. Even if you end up not needing a lawyer, talking to one early gives you peace of mind. You deserve to at least understand what your options are. Take care of yourself 💙

    Stop answering the adjuster's calls without knowing what you're doing. You don't owe them chatty updates on how your back feels. Call a PI attorney this week, get a free consult, and let them advise you on whether and how to communicate with the insurance company going forward. You're three weeks in — you haven't blown anything yet, but the window to make a misstep is wide open right now.

    Please keep going to your doctor and document everything — every symptom, every appointment, every time you had trouble sleeping or couldn't turn your head fully. Soft tissue injuries are real but they're also really easy for insurance companies to dismiss because they don't always show on imaging. Your medical records are going to be your best evidence of what you actually went through, so the more thorough the paper trail, the better. Don't let anyone talk you into feeling like your pain isn't valid.

So there's really no financial risk in just calling and asking questions. Also worth knowing: every state has a statute of limitations on personal injury claims. You've got time, but the clock is running. Getting a consult now doesn't mean you're filing a lawsuit — it just means you understand your options. That's always a good position to be in.
